These SoundCloud Artist Subscriptions Terms of Use (the “SoundCloud Artist Terms”) and if applicable the SoundCloud Monetization Terms of Service, are in addition to and are governed by SoundCloud’s Terms of Use (the “Terms of Use”) together with our Community Guidelines, Privacy Policy and Cookie Policy and any other terms specifically referred to in any of those documents (collectively “the Documents”). In the event of a conflict between the SoundCloud Artist Terms and any other Documents, the SoundCloud Artist Terms shall prevail solely in respect to your use of SoundCloud Artist Subscriptions. Capitalized terms used in these SoundCloud Artist Terms not specifically defined in these SoundCloud Artist Terms shall have the meanings given to the applicable capitalized terms in the Documents.
Certain features of the Platform are only available to registered users who subscribe to an “Artist Pro,” “Artist,” or “Basic” plan or the legacy plans “Next,” “Next Pro,” or “Next Plus” (each an “Artist Subscription”). Below, you’ll find a few additional terms that apply to those Artist Subscriptions, including amongst other things, terms relating to payment, the conclusion and renewal of your Artist Subscription, your right of withdrawal during the first fourteen (14) days of your subscription, and certain technical usage limitations. SoundCloud, at its sole discretion, may make unavailable for purchase, downgrade, or upgrade any of the Artist Subscriptions through particular points of purchase (such as our website or third party app stores) or in particular territories.
A detailed description of our Artist Subscriptions, including the prices and the features associated with each type of account, is available on our Artist Subscriptions plan page.
All prices include VAT or other sales tax where applicable.
To purchase an Artist Subscription on the SoundCloud Website or a third party app store (“Third Party Store”), select the Artist Subscription you want to purchase from the Artist Subscriptions plan page on that platform, then select your preferred billing cycle (where applicable). Next enter your payment details and then click the “Buy Subscription” or “Subscribe” button.
Selecting an Artist Subscription and submitting your payment information is an offer to conclude a contract. The contract itself is not concluded until you receive confirmation from us or until we activate your Artist Subscription, as described below.
Once your payment has been received, your Artist Subscription will be activated, and we will send confirmation of your activated subscription by email to the address associated with your account; this does not apply to the “Basic” and “Next” tiers, which do not require a payment.
The contract for your Artist Subscription is concluded when you receive our confirmation email (or when we activate your account, if this happens first), not when you make your payment.
Payments for Artist Subscription are payable in advance and will be taken at the time the contract is concluded as described above. Payment can be made by Visa, Mastercard or PayPal and/or any other payment method that is presented to you during the purchase process.
If you choose a monthly payment option, your Artist Subscriptions will run from month to month (each such month a “Billing Month”), and will renew automatically at the end of each Billing Month unless you cancel your Artist Subscription before the applicable date of renewal. Payment for the next Billing Month will be taken at the applicable date of renewal.
If you purchase an annual Artist Subscription, your initial Artist Subscription will be for a twelve (12) month period and your Artist Subscription will renew automatically for additional, successive twelve (12) month periods thereafter (each such twelve-month period a “Billing Year”). SoundCloud will automatically charge your payment account for the associated Artist Subscription fee on the date of commencement of each applicable Billing Year unless you cancel your Artist Subscription before the applicable date of renewal.
If you purchased your paid Artist Subscription on the Website, you can only cancel your Artist Subscription at any time on your subscription tab on the Website, where you will also find your Artist Subscription expiry date. If you purchased your Artist Subscription through a Third Party Store, you can only cancel your paid Artist Subscription through the subscriptions settings within your account with such Third Party Store.
AUTOMATIC RENEWAL: AS STATED ABOVE, IF YOU DO NOT CANCEL YOUR SUBSCRIPTION PRIOR TO THE COMMENCEMENT OF AN APPLICABLE BILLING MONTH OR BILLING YEAR, WE WILL AUTOMATICALLY CHARGE YOUR PAYMENT ACCOUNT AT THE BEGINNING OF EACH SUCCESSIVE BILLING MONTH OR BILLING YEAR, AS APPLICABLE.
If you already subscribe to a “Go”, “Go+” or “DJ” plan (together “Fan Subscription”) with SoundCloud and wish to purchase an Artist Subscription in addition to your Fan Subscription, you may do so at any time from the Plan Picker page on the Website or Apps. The account information associated with your Fan Subscription will be used in connection with your new Artist Subscription, however, the pricing and features associated with your Fan Subscription will run independently from your Artist Subscription. In some cases, the billing cycles of your respective Fan Subscription and Artist Subscription may differ as to frequency, anniversary date, or both.
You may upgrade or downgrade between different Artist Subscriptions on your subscriptions tab on the Website or Apps, subject to feature availability and Artist Subscription availability at that point of purchase and in your territory. If you upgrade to a higher-priced Artist Subscription, you will immediately be charged the difference in price between the two subscriptions. This amount is determined based on how far you are into the billing cycle of your initial Artist Subscription at the time you upgrade. Your renewal date of your Artist Subscription will change to the day you changed your Artist Subscription. You will be entitled to use your new Artist Subscription immediately after you make the change.
If you downgrade to a lower-priced Artist Subscription, your former Artist Subscription will continue to be accessible with the same features until the end of your current billing cycle and, after such time, your Artist Subscription will convert to the features and price associated with the Artist Subscription to which you downgraded.
In the event you downgrade your paid Artist Subscription, after such action, any Content in your account that exceeds the then-current upload limit for an Artist or Basic account (as applicable to the plan to which you downgraded) will be hidden. You will still be able to access hidden Materials if you want to delete them.
Under applicable law, if you are a consumer in the European Union (EU), the European Economic Area (EEA), or in the U.K., you also have a legal right to withdraw from your purchase of an Artist Subscription within fourteen (14) days of your purchase, as set out below:
Model instructions on withdrawal: You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period will expire after fourteen (14) days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email) at either of the following:
You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we shall reimburse you with all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen (14) days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated your withdrawal from this contract, in comparison with the full coverage of the contract.
Following receipt of your notice of withdrawal, SoundCloud will downgrade the applicable Artist Subscription to a Basic subscription. Any Content in your account that exceeds the then current upload limits for a Basic account will be hidden. You will still be able to access hidden Materials if you want to delete them.
If you wish to delete your SoundCloud account altogether, you can do this from the account tab within your account settings on the Website or Apps.
Please note that Artist Subscriptions are subject to monthly upload limits and a maximum individual file size. This is necessary to ensure the stability of the Platform. Individual uploads must not exceed four (4) GB and the upload time per month must not exceed twenty (20) hours in total.
This will not affect the ability of Next Pro and Artist Pro users to upload an unlimited number of sounds, provided that individual files are within the file limits, and provided that the monthly upload limits are not exceeded.
Certain Artist Subscriptions are subject to additional Limitations as described in the section below.
We may from time to time change the features of our Artist Subscriptions and/or change the prices charged to these accounts. In the event of any increase in the price or material reduction in the features of any Artist Subscriptions to which you subscribe, we will communicate these change(s) to you at least six (6) weeks in advance and the changes will only take effect with respect to any subsequent renewal of your subscription.
Certain Artist Subscriptions may include limitations on the availability of certain features or benefits and/or limitations on the number of times a subscriber may use a particular feature or benefit within a period of time (“Limitations”). The period of time we use for time-based Limitations is one month (“Month”), beginning on the date of activation of your Artist Subscription and repeating every month thereafter as long as your Artist Subscription is active.
We may use a credit system to account for the number of times you use a feature or benefit subject to a Limitation, should such feature or benefit be available under the applicable Artist Subscription (“Credit System”). Each use of such a feature or benefit during a Month shall represent one “Credit,” and each such use will reduce the number of uses of that feature or benefit available to you during that Month by one Credit. Your Credits will be available to use immediately upon activation of your Artist Subscription and will refill on a Monthly cycle thereafter while your Artist Subscription remains active. When the number of your Credits for a feature or benefit reaches zero, no additional uses of such feature or benefit during that Month will be available to you.
Where a Credit for a feature or benefit allows you to take a particular action with respect to a track, use of such feature or benefit with respect to a track will represent one Credit. Performing the same action with multiple tracks will require multiple Credits. For example only, distributing one track to third party DSPs will consume one Credit for the distribution feature; distributing an “EP” of three tracks to third party DSPs will consume three Credits; distributing a larger quantity of tracks than the number of your remaining distribution Credits available in that Month will not be possible—only the number of tracks corresponding to the number of your remaining distribution Credits available in that Month will be possible to distribute during that Month.
Credits correspond to individual features or benefits. Credits for one feature or benefit cannot be used with other features or benefits or other SoundCloud services. Credits are valid for a limited time and expire at the end of each Month and upon the termination of your applicable Artist Subscription. Except as described below, Credits do not carry over or accumulate from one Month to any subsequent Month. Credits have no cash value. Credits cannot be transferred to any other user of the Platform. There can be no negative Credit balances.
We may from time to time, and at our sole discretion, refund to your Credit balance a Credit you used when such use did not result in the successful performance of the feature or benefit to which that Credit corresponds; in such an event, the refunded Credit will expire for use at the end of the Month following the Month in which such refund occurred.
Last Amended: August 27, 2024
